Oh. No. This one works. The problem is, most men are not paranoid enough to preempt their partner and press charges first. But when it happens, yeah, it basically shuts out the other charges. Which is STRANGE, but that's how the legal system works in the US. And by pressing charges first, I mean, YOU GO TO THE COPS AND CLAIM TO HAVE BEEN RAPED.

Which, under the law, if you have sex while you are drunk, then, as a man, you are. It's insane, but that's how the law is, in most states.

It's like how if a woman has sex with an underage boy, it's statutory rape, but the kid still needs to pay child support if she gets pregnant and carries the baby to term. Which under most states involves the parents being forced to pay the child support or the father will be sent to jail.

Its really no wonder people aren't having as many babies in certain countries as before, society is fucked up beyond recognition and its dangerous to interact with other humans in general.

The lowest fertility rates are in South Korea, Singapore and Hong Kong. The biggest factors seem to be careers getting in the way, and the high cost of raising kids.
The highest fertility rates are in underdeveloped, dysfunctional, dangerous parts of Africa: Niger, Somalia, Congo, Mali and Chad. Which of these societies is more effed up?

Modern society is reducing fertility rates, but the reasons are subtle and indirect. France, Sweden and New Zealand have higher fertility rates than Italy, Finland, and Hong Kong. Why? Probably nothing to do with the topic of discussion here.

The definition of rape can vary among the states to some extent. However, generally speaking, whether or not someone is too intoxicated to know what they are doing, and therefore lack the ability to give consent, is a matter of fact determined on a case-by-case basis by the trier of fact (e.g., jury). To complicate matters further, being intoxicated in itself is not necessarily the basis for rape unless the alleged rapist knows or should have known that the person giving consent is intoxicated. That too is a matter or fact for a jury to decide. Circumstances matter. And as is often the case with the law in the U.S., there are no easy answers unless one is dealing with statutory rape of a person below the age of consent in which case consent is generally irrelevant.
