Some Spanish lady/guy wrote to me that she/he used my smutty BL German Hetalia fanfic, not the original story, just checked, in her blog. The problem is, that she is teaching children German with it.

The question is, will I end up being sued for something like that? If the parents find out, they will want my head on a spike. I am pretty sure that I put smut in there because pretty much everything I wrote during that time frame had smut in it.

I did not contact this blogger, and did not get paid. Can I use these two facts in court?

The problem is, you opened this thread. Now you can't deny you knew about it and did nothing because, well, you didn't know about it.

Never do that. You could have claimed, you never read the email. Now that is no longer the case.

I had it marked as Mature, so that should be fine. It is not like I was too descriptive. And I don't think the kids can even read the story, unless they lie about their age, or something.

Why would you be responsible for what she's teaching them with? :blob_neutral: She's the teacher and she is responsible for providing teaching material to her students. It's the teacher's obligation to make sure the material is suitable for students, not the author of something that wasn't even meant for teaching.

It’s your writing so they should have asked you whether she can use it or not.

But why would they use a non-native authors writing to teach German? This is suspicious. Maybe it’s just a text passage that they are using.

As for suing, absolutely unfounded. This wasn’t meant to be teaching material, wasn’t advertised as such, and who uses AO3 as source? The parents would rip at the teacher before going after an anonymous author in the www.

A guard was reading a textbook, chilling in the church. He, as usual, was sitting near a dangerous place. A place where humans can lose their minds easily. Every day, a lot of people went to the place. We're talking hundreds of people, stepping into danger of their own will. And he told everyone about it. One day, a man walks past him. Doing his daily routine, he shouts at the man, warning him that the direction he's heading to is a place to die. The man nods and continues his walk.

The next day, the same man brought some children along with him. And, coincidentally, the guard fell asleep. Some visitors told him about the guard's announcement. Yet, he chose to deafen himself from them. And of course, the children died.

Some people said that the guard made a mistake by sleeping. Well, some.

To the judges and the people who know the laws, it was the man's fault.

Yes, the guard sleeping at work was not what a guard is supposed to do, but the guard was busy helping the townee build a bridge one night before that. And, why didn't the man listen to the people's warning? Which means, why didn't he listen to the guard?

My point is:

You've warned her. Yet, she uses your work as a subject to teach. She was either oblivious to your warning, or she didn't see the warning. Tell her that you had warnings stuck on your novel and that she didn't see it.

This is also a lesson to learn for you. Even with the warnings feature developed by the web's creators, you still need to put some content warnings in the synopsis.


Now now, if somehow she dares to speak that it's your fault, do tell us, Scribblers.

I'd say you are safe.... she may get in trouble with the parents as they would have the reasonable expectation that someone using a story to teach kids would have read the story, so in this case would know it has smut... But you as the author have no control in how a private citizen uses your story.

I honestly would have expected she'd use Duolingo because that is colorful and cartoonish. The kids who she had on her website were very young.
